By accessing KartingClassifieds.com and/or using services provided by KartingClassifieds.com you agree to comply with all our terms, conditions and policies listed below. KartingClassifieds.com is provided by Pure Industries Inc., Hamilton, ON, Canada.
In order to access and use KartingClassifieds.com, you may be required to register with us and setup an account using your email address and a password. You are solely responsible for maintaining the confidentiality of your password. You are also solely responsible for all activities that occur under your account which is managed through “my dashboard”. Your password should be difficult for others to guess. If you believe your account has been compromised please contact KartingClassifieds.com.

DISCLAIMER AND LIMITATIONS OF LIABILITY

KartingClassifieds.com is provided as a service to the public. KartingClassifieds.com is provided “as is” and “as available”. You will not hold KartingClassifieds.com responsible for posts or action of users of KartingClassifieds.com. KartingClassifieds.com is made up mainly of content and items generated by users and we do not guarantee the accuracy of postings or user communications or the quality, safety, or legality of what is offered.

KartingClassifieds.com does not warrant that the functions contained in the website and/or services will be uninterrupted or error free; including but not limited to access, system notifications, security, delays and latency.

KartingClassifieds.com disclaims all warranties, representations and conditions, express or implied, including but not limited to quality, merchantability, durability and/or fitness for a particular purpose. This includes both advertising found on KartingClassifieds.com and links to information contained on KartinClassifieds.com’s pages to outside other websites.
In no event will KartingClassifieds.com be liable for any damages, including but not limited to any lost profits, lost savings or other incidental, goodwill, reputation or any consequential or special damages arising out of the use of or inability to use KartingClassifieds.com, even if KartingClassifieds.com has been advised of the possibility of such damages. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

INDEMNIFICATION

You will defend, indemnify, save and hold harmless KartingClassifieds.com, its affiliates, subcontractors, agents, clients, servants, officers, directors and employees from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees associated to your use of KartingClassifieds.com site and/or services, any alleged violation by you of the applicable terms, and any alleged violation by you of any applicable law or regulation. This includes any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against KartingClassifieds.com, its subcontractors, agents, clients, servants, officers, directors and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by users of KartingClassifieds.com and/or advertisers on KartingClassifieds.com. You also agree to defend, indemnify and hold harmless KartingClassifieds.com against liabilities arising out of any injury to person or property caused by any products or services sold or otherwise distributed posted by you and/or KartingClassifieds.com advertisers. This includes infringing on the proprietary rights of a third party, copyright infringement, and delivering any defective product or misinformation which is detrimental to another person, organization, or business.

CHOICE OF LAW

This Agreement and its applications or interpretation shall be governed exclusively by the laws of Ontario Canada; Client irrevocably attorns to the jurisdiction of the courts of the Province of Ontario.
